En tout cas, ça en a l’air. Il est laborieusement résulté de notre enquête menée auprès de l’appareil judiciaire militaire que certaines pratiques des agents de différentes juridictions militaires en Ituri (greffiers, secrétaires des parquets, juges et auditeurs) crachouillent sur les efforts consentis par ces juridictions qui dit le droit en application de la loi pénale militaire.

Selon les réponses des personnes qui avaient déjà à faire à la justice militaire en Ituri, quasiment toute la procédure judiciaire se caractérise par ce que les agents appellent « motivation ». Le cas de ces trois personnes, victimes de viol, de menace de mort, de destruction méchante d’une part et accusée de viol sur mineure, participation au mouvement insurrectionnel d’autre part, l’illustrent mieux.

Je vais l’appeler Machozi pour des raisons de sa sécurité. Souffrante des douleurs des infractions graves, cette femme d’une trentaine d’années, après avoir saisi la justice militaire, continue de chercher le montant de 100 dollars exigé par cette dernière pour déployer les agents afin d’appréhender [un agent de l’ordre], auteur du viol. Pendant que le présumé coupable erre librement en ville, Machozi vit, la peur au ventre, subissant continuellement des menaces de la part du présumé violeur, par manque de montant exigé. Elle est en conséquence victime de la corruption et risque d’en payer de sa vie.

De l’autre côté, c’est celui que j’appelle Tagirabo, qui languit à la prison centrale de Bunia et ne sait à quel jour sera fixée sa date de comparution. Poursuivi pour sa présumée participation à un mouvement insurrectionnel, à lui, le service du greffe exige une « motivation » de 75 dollars américains, « car nous avons beaucoup des dossiers à traiter » m’a dit le greffier, témoigne le justiciable. Il en est de même pour l’autre victime de la corruption exigée par les agents de la justice militaire que je nomme Afoyo. Il lui a été demandé la « motivation » des juges pour savoir l’issu de son dossier pris en délibéré. Poursuivi pour viol sur mineure, il est à la recherche d’au moins 200 dollars.

Comment les agents de la justice militaire commettent-ils la corruption ?

Selon les justiciables, les agents œuvrant au sein des juridictions et offices militaires (greffiers, secrétaires des parquets, juges et auditeurs) utilisent pratiquement deux (2) modus operandi pour atteindre leur proie: plus souvent, ce sont les avocats et les greffiers qui sont mandatés par les juges pour cette fin. Le montant exigé dépend de l’apparence de la personne et du dossier. Du moins, ça varie entre 20 à 500 dollars américains. Les juges et greffiers les plus courageux appellent par téléphone les justiciables.

Il est vrai que tous les agents de la justice militaire ne sont pas emportés par cette pratique qui énerve la loi congolaise dans son code pénal livre 2, à son article 147. Cependant, les auteurs de cet acte restent impunis faute de non dénonciation par les victimes qui craignent pour leurs vies.
